(A) All-India Services Act (61 of 1951) , S.3— All India Services (Performance Appraisal Report) Rules (2007) , R.5— Performance Appraisal – Comments Of Accepting Authority- Compliance with timelines – Timeline prescribed under the schedule was contravened – Under the PAR Rules a contravention of said timelines, neither renders the PAR invalid, nor it is met with any identified immediate consequence – Accepting Authority had met the timelines prescribed under Rule 5(1) of the PAR Rules – In view of compliance with mandatory timelines prescribed under the PAR Rules, there was no reason to expunge remarks

(B) All-India Services Act (61 of 1951) , S.3— All India Services (Performance Appraisal Report) Rules (2007) , R.9— Performance Appraisal – Reduction in grades – Accepting Authority had changed grades of IAS Officer from ‘9.92’ to ‘9’ – Plea was taken that it would affect the officer’s chances of promotion – Overall grade ‘9’ formed part of ‘outstanding’ grade i.e., highest category awarded to an IAS officer – Said overall grade was more than sufficient for promotion – Hence, plea that prejudice had been caused to the officer by such gradation was not tenable.
