Constitution of India , Art.32, Art.227— Public Interest litigation – Expeditious disposal of criminal cases against elected members of Parliament and Legislative Assemblies – In the interest of justice, certain directions were issued .

That after analysing all India data on the pendency of cases against elected members of Parliament and Legislative Assemblies in States and Union Territories, that there were multiple factors which had direct bearing on decisions or measures that could be adopted for early disposal of cases. Each of them influenced early disposal of the subject cases. This, coupled with their dissimilarity from State to State, made it difficult for Court to form a uniform or standard guideline for trial courts across the length and breadth of this country to dispose of the subject cases. The High Courts were dealing with these issues on the judicial and on the administrative side, and they were alive to the position that existed in each of their district courts. Under Art.227, the High Courts were entrusted with the power of superintendence over the district judiciary and it would be appropriate to leave it to the High Courts to evolve such method or apply such measure that they deem expedient for an effective monitoring of the subject cases.
